TERMS & CONDITIONS

You are deemed to have read and accepted the following Terms & Conditions governing your purchase of this product:

Foreword
Sri Sutra Travel (the Company) may be referred to as "our" or "we" in the Terms & Conditions. The Reservation Services availed on SUTRAonline accessed via the Internet at the URL: www.srisutra.com.my is offered to you on the express condition that you (the User) accept without varying the terms and conditions set out herein.
We may amend the terms and conditions from time to time without notice to you and you are required to read, understand, and accept the terms and conditions prior to each time you use the Reservation Service.


Change in Terms and Conditions
You are advised to refer to the Terms and Conditions each time you access this Website to ascertain and understand any deletions, modifications, variations and/or additions that may be made to the Terms and Conditions from time to time, and you shall be deemed to have agreed to and accepted the Terms and Conditions, including such deletions, modifications, variations and/or additions each time you access and use this Website.


1. USER COVENANT
You agree to:

  1. Indemnify the Company, its Directors, and employees from any claims and/or losses that may arise from your use of the Reservation Services and the products or services associated with it.
  2. To bear full financial responsibility for all uses of the Reservation Service by you and those using your credit card information, including but not limited to minors living with you and to supervise all usage by such minors of the Reservation Service.
  3. Not to use the Reservation Service in any way this interferes with its availability for other users.
  4. Not to use the Reservation Service to make any speculative, false or fraudulent booking/reservation or any booking/reservation in anticipation of demand.
  5. All information supplied by you in using the Reservation Service is complete, true and accurate.

2. DISCLAIMER
THE USE OF THE RESERVATION SERVICE IS AT YOUR SOLE RISK. THE RESERVATION SERVICE (INCLUDING ALL THE PRODUCTS AND SERVICES) ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND AND YOU ASSUME TOTAL RISK AND.
The information contained in the Reservation Service is subject to change without notice.


3. LIMITATION OF LIABILITY
Notwithstanding anything contained in the Terms & Conditions, the liability of the Company shall in no event exceed the amount paid by the User for any booking/reservation using the Reservation Service OR Ringgit Malaysia One Thousand (RM1,000) only, whichever shall be the lesser.


4. ACKNOWLEDGEMENT

  1. Your acceptance of the entire terms and conditions as set out is fundamental to the purchase made by you.
  2. You further agree that the Company would not otherwise be able to offer the products and services on its present basis without your acceptance of such terms and conditions.

5. FORCE MAJEURE
The Company will not be held liable or any damages or loss arising from any events which are beyond the reasonable control of the Company. Such an event shall include but not limited to any Acts of God, earthquakes, typhoons, flood, natural disaster or fire, strikes, dangers incidental to sea, land and air travel, government action, compliance with any laws, regulations or orders, civil war, industrial disputes, power failure, hardware and or system failure, malfunction or breakdown, failure of internet transmission or links, system hacking, software contamination, or corruption, howsoever caused.


6. TAXES
You shall be fully responsible for any and all taxes arising from your purchase made vide the Reservation Service.


7. CHANGES TO RATES
The rates quoted on the Web Site in respect of the Travel Products are correct at the time of publication. The Company reserves the right to revise the rates at any time and from time to time without prior notice.


8. RESERVATIONS

  1. The Company is entitled at their discretion to refuse and/or decline to accept any booking or reservation placed through the Reservation Service.
  2. The Reservation Service will not be held liable nor entertain a refund of any nature should you book or reserve a Travel Product that is not suitable.
  3. The Company shall process any special requests you have but cannot guarantee the availability of the same.
  4. All bookings or reservations are non-exchangeable and non-transferable
  5. To confirm your bookings or reservations, you are required to complete the Review & Booking portion of the Reservation Service process using a valid MasterCard or Visa credit card.
  6. When making an online reservation via the Reservation Service, you shall receive an automated email confirmation from the Company acknowledging your payment made for your purchase.  
  7. If for any reason whatsoever you do not receive an email confirmation from the Company, you are solely responsible and required to check the status of your reservation request by e-mailing your query or contacting your Travel Designer at  +603- 40266677.
  8. Non-receipt of an email confirmation by the Reservation Service shall not invalidate your reservation nor render the same void.

 

9. TRAVEL REQUIREMENTS

  1. It is your responsibility to obtain a visa (where required) and other relevant travel documents at your own cost.
  2. Please ensure that you have a valid passport for the duration of your trip.

10. CURRENCY
The Reservation Service accepts payment in Malaysian Ringgit. Exchange rates incurred on non-Malaysian issued Credit Cards are determined by your Issuing Bank and the Company Sri Sutra Travel is not liable for any gain or loss incurred.


11. CONFIRMATION OF BOOKING/RESERVATION

  1. Once you have made your payment for your booking/reservation, you must print the confirmation voucher for your reservation showing the details of the booking/reservation.
  2. You will also receive an automated email confirmation via the email address provided by you.
  3. You are required to check the details in the confirmation voucher and ensure that all the details contained in it is correct; otherwise you may not be able to peruse the Product and/or Service for which it is meant for.

12. AMENDMENTS AND CANCELLATION
All cancellations or amendments are subject to the following charges:

  1. The above charges are in addition to the Total Value of your purchase; of which both shall be charged to the credit card previously supplied by you during the Review & Confirm Booking stage in the Reservation Service booking process.
  2. Any request for cancellation or amendment must be made and authorized by you in writing (by fax or email).
  3. You agree NOT to hold the Company liable in the event that the Product after amendment fails to be confirmed.

13. REFUND POLICY
Should you decide to cancel your booking/reservation you may be entitled to a refund depending on the nature and validity of your request which shall be at the sole discretion of the Company. All such refund (if any) shall be made in Ringgit Malaysia and paid to your credit card vide the credit card company after due course and due process.

14. RIGHT TO REJECT
The Company reserves the right to withdraw and make void any bookings/reservation for any customer if the Company has reason to suspect or has knowledge that the presence of the said customer jeopardizes either the health & safety or affects the comfort or enjoyment of other travelers. Under such circumstances, the Company’s sole liability shall be limited to a refund of the payment made for the product for the said customer LESS any service fees and/or taxes.
All such refund (if any) shall be made in Ringgit Malaysia and paid to your credit card vide the credit card company after due course and due process.
15. PAYMENT

  1. Full payment for the product purchased is required BEFORE confirmation of the booking/reservation.
  2. Exception; for Plan Tour (FIT) packages a deposit booking fee of RM 100.00 per person is required upon reservation/booking. Balance must be made no later than 10 days before departure. Failure to comply with this may result in an automatic cancellation of your reservation. If reservation is made less than 10 days before departure, the whole amount must be paid upon confirmation.
  3. Peak Season surcharges which if not expressly stated to be included in the fare, shall be payable by you.

16. PRODUCT CANCELLATION/RESTRICTION FROM SALE
In the event the Company decides to cancel the availability of the Product; which it reserves the right to at any time without notice or assigning any reason whatsoever – the Company may offer you alternative products. Should you decide not to accept such alternatives, such refund shall be made in Ringgit Malaysia and paid to your credit card vide the credit card company after due course and due process. Payment for such Travel Packages must be made IN FULL by credit card via online transaction upon booking/reservation.

17. PRODUCT PRICE INCLUSIVE & EXCLUSIVE
The product price is inclusive only of the items expressively specified in the Tour Itinerary, Brochure, or Travel Forms.

18. CHILD RATES

  1. Child rates may apply for children aged 12 years & below and on the date of departure from Malaysia. Child rate is based on twin share with 2 adults without any extra Child Bed.
  1. If you require an extra Bed for the Child, please select the relevant options provided in the Reservation Service or inform Your Travel Designer. You shall be advised accordingly of the surcharges or Child Supplement rate to be paid, if any.

19. ACCOMODATIONS

  1. Accommodation type and rating is specified in the tour brochure and/or booking form.
  1. Accommodation for adults is based on twin share and surcharge may apply if otherwise.
  1. For triple share accommodation, the third bed may be a portable or “rollaway” bed or Sofa Bed.

20. SINGLE SUPPLEMENT
Single supplement rate applies when you select non twin share accommodation.

21. AMENDMENT TO FLIGHTS & TOURS

  1. Your confirmation voucher when inclusive of Flights is restricted to the specified Airline. It is not negotiable, refundable, endorsable nor re-routable. Any request to alter the flight is solely at your own risk and is chargeable.
  1. Unused ticket(s) are not refundable in part or in whole.

22. EXTENSION STAYS

  1. Extension stays may be permitted at the end of the Tour and is subject to the maximum validity and restriction of the Airline, availability of accommodation prior and/or at the end of the original tour stay.
  1. All additional cost associated to the same is to be borne by you. This includes airport transfer and extra accommodation stay.

23. AMENDMENT TO TOUR ITINERARY BY THE COMPANY
The Company shall make all effort to avoid any change in the Tour Itinerary and reserves the right to make changes at any time. Changes if any shall be informed to you and should you decide not to accept such changes, such refund shall be made in Ringgit Malaysia and paid to your credit card vide the credit card company after due course and due process LESS any service charges and/or taxes, if any.

 24. BAGGAGE

  1. You are allowed baggage not exceeding 20 kilograms; unless otherwise specified by the airline.
  1. You are allowed one piece of hand luggage.
  1. Charge for excess baggage is for your account and payable at the point of charge.

25. NO VARIATION OF THE TERMS & CONDITIONS
The Terms & Conditions mentioned here cannot be altered or waived except by mutual agreement in writing between the Company and you.
